General Terms of Sale

These General Terms and Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, persons wishing to make a purchase via the Essences Agape website, https://essences-agape.com, hereinafter referred to as "the Customer", and on the other hand Essences Agape, a company whose registered office is located at 14, quai de la Mégisserie – 75001 Paris, France, registered with the Paris Trade and Companies Register under number 833627714, email address: essencesagape@gmail.com (hereinafter "the company" or "we").

Essences Agape is a registered and protected trademark.
It is registered under the company Modern Gentleman in the Official Bulletin of the National Institute of Intellectual Property (INPI) under the national number 21 4 780 013 .
The company operates a business of candles, incense (including bukhoor), wax melts, soaps, bath salts, and ritual accessories, represented by its manager, Mr. François Morice, residing in Paris (75).

The Customer and Essences Agape are hereinafter referred to as "the Parties".

These conditions apply exclusively to non-commercial natural persons.

The purchase of a good via this site implies full and unconditional acceptance of these General Terms and Conditions of Sale.

Article 1 – Order

1.1 Parcel shipment is carried out only within mainland France.
1.2 The Customer's order concerns products listed in the Essences Agape online catalog.
1.3 The order can only be recorded if the Customer has clearly identified themselves (last name, first name, valid email address, postal address, phone number, and date of birth).
1.4 Any order implies acceptance of the prices and descriptions of the products available for sale.
1.5 Orders are payable only in euros including all taxes.
1.6 Essences Agape commits to honoring orders received within the limits of available stock.
1.7 The sale dates applied are those in effect in the region where the company's registered office is located.

Article 2 – Validation

2.1 By confirming their order, the Customer acknowledges having read and accepted without reservation these General Terms and Conditions of Sale.
2.2 Unless proven otherwise, data recorded by Essences Agape constitutes proof of all transactions.

Article 3 – Availability

3.1 Offers and prices are valid as long as they are visible on the site and within available stock limits.
3.2 In case of unavailability of a product after order confirmation, Essences Agape will inform the Customer as soon as possible. The order will be canceled, held, or modified at the Customer's request.
3.3 Availability information is given for guidance only: products are only reserved after payment.

Article 4 – Delivery

4.1 The preparation time is 24 to 48 hours. Delivery takes 2 to 5 business days in mainland France and the USA, 2 to 7 days in the DOM-TOM, and up to 8 days internationally.
4.2 In case of items deliverable on different dates, the longest delay applies. Essences Agape reserves the right to split the delivery at no extra cost to the Customer.
4.3 In case of a delay of more than 14 days, the Customer may request contract termination and a refund within 14 days.
4.4 The Customer must check the contents of the package upon receipt and report any anomalies to essencesagape@gmail.com.

Article 5 – Payment

5.1 Prices are indicated in euros including VAT (20% VAT), excluding shipping costs.
5.2 Essences Agape reserves the right to change its prices at any time.
5.3 Products are billed according to the rates in effect at the time of the order.
5.4 Products remain the property of Essences Agape until full payment is made.
5.5 Payments are made by credit card or PayPal.
5.6 Transactions are secured via Shopify Payments (SSL – Secure Socket Layer solution). All data is encrypted to ensure confidentiality.

Article 6 – Returns and Refunds

6.1 Order Error:
In case of an error attributable to Essences Agape, return and reshipping costs are borne by the company.

6.2 Client Withdrawal:
The Client has a legal period of 14 days from receipt of the package to exercise their right of withdrawal.
Return costs are the responsibility of the Client (except in exceptional cases).
Products must be unworn, unused, and in their original packaging.

6.3 Refund:
The refund is made within a maximum of 7 days after receipt of the compliant items.
The refund includes the initial delivery fees, if charged.
Damaged, used, or modified products are neither accepted back nor refunded.

Article 7 – Warranty

7.1 Essences Agape guarantees its products against hidden defects and manufacturing faults for 14 days after receipt.
7.2 This warranty does not cover: consumables, damages related to abnormal use, or unauthorized interventions.

Article 8 – Liability

8.1 Product photos are presented for illustrative purposes only.
8.2 Essences Agape disclaims all responsibility for the content of external sites accessible via hyperlinks.
8.3 In case of purchase for professional purposes, no compensation will be due for indirect losses.
8.4 The company cannot be held responsible in case of force majeure or fault attributable to the Client.

Article 9 – Mediation

In accordance with articles L612-1 and following of the Consumer Code, any unresolved dispute may be submitted to a consumer mediator, free of charge for the Client.

Article 10 – Anti-Fraud Measures

10.1 Order information is subject to automated processing for fraud detection (via Shopify).
10.2 In case of non-payment due to fraudulent use, the Client's details may be recorded in a payment incident file.
10.3 In accordance with the Data Protection Act No. 78-17 of January 6, 1978, and the GDPR, the Client has the right to access, rectify, and object by writing to:

Article 11 – Applicable Law

This contract is subject to French law.
In case of dispute, only French courts have jurisdiction.
This contract is written in French.

Article 12 – International Orders

12.1 The Client is the importer when ordering from another country. They are responsible for paying customs duties, local taxes, or applicable import fees if Essences Agape decides so.
12.2 The Client must verify the legislation of the destination country before any order and ensure that the products are authorized for import.

Article 13 – Gift Cards

Gift cards are neither exchangeable, refundable, nor convertible into cash.
No price difference can give rise to reimbursement by Essences Agape.

Article 14 – Product Protection

Essences Agape designs and manufactures its products and provides, on each product sheet, usage instructions, precautions/contraindications, and, if applicable, safety data sheets (SDS).

The Client agrees to strictly comply with these instructions. Essences Agape cannot be held responsible for damages resulting notably from:
(i) from use not in accordance with instructions, warnings, or applicable standards;
(ii) from use under abnormal or dangerous conditions (lack of ventilation, proximity to flammable materials, use near children/animals, etc.);
(iii) modifications, alterations, or mixing with third-party products;
(iv) improper storage or maintenance.

In case of a complaint, it is the Customer's responsibility to provide any evidence establishing an intrinsic defect of the product and the conformity of use with the provided instructions. Otherwise, Essences Agape's liability cannot be engaged.

Essences Agape products are handmade in limited quantities and may require additional preparation time before shipment.

This clause applies without prejudice to legal guarantees of conformity and hidden defects (Consumer Code art. L.217-3 et seq.; Civil Code art. 1641 et seq.).

Any customer remains free to express a sincere, reasoned, and proportionate opinion on Essences Agape products. However, any publication or public dissemination of false, defamatory, insulting statements or those intended to deliberately disparage the brand, its products, or its teams, especially when these statements concern variations expressly announced between visuals and delivered products, may engage the responsibility of their author under applicable provisions, notably the law of July 29, 1881 on freedom of the press (public defamation and insult) as well as article 1240 of the Civil Code relating to tort liability. Essences Agape reserves the right to take any useful action, including reporting to the relevant platforms and, if necessary, legal proceedings.

By confirming your order, you acknowledge and accept these conditions, including the limited nature of the series and the natural variations related to artisanal manufacturing.

Article 14 – Complaints

The photographs and visuals shown on the site are non-contractual: due to the artisanal nature, the use of natural materials, and our maturation processes, slight variations in color, texture, size, or shape may occur without affecting the quality or compliance of the product. These variations shall not constitute a defect or a reason for complaint.
